Drunken Driver Responsible for Accident in St. Louis County Arrested

A St. Louis County, Missouri car accident leaves two people injured. The three-vehicle accident happened on August 17, 2011 close to midnight on the eastbound lane of I-64 near Timberlake Manor Parkway. The Missouri car accident happened as Susan Dunakey drove her 2000 Jeep Cherokee the wrong way in the eastbound lane. Dunakey crashed head on with Darnell L. Warner’s 1993 Ford Escort. The impact of the Missouri car accident spun Warner’s vehicle into the path of a 2002 Peterbilt semi-truck. The truck slammed into the passenger side of the Ford Escort and crashed off the highway into a sign.

Darnell Warner, a 23-year-old, was listed in serious condition after being transported to the St. John’s Mercy Medical Center in Creve Coeur, Missouri by the Monarch Ambulance. Chesterfield resident, Susan Dunakey, failed the sobriety test given by St. Louis County, Missouri authorities. According to reports, the Missouri State Highway Patrol arrested the 50-year-old Dunakey, the day following the accident for drunk driving after she was treated and released for minor injuries.

Syreeta A. Holland is at DePaul hospital after being injured in a Missouri rear-end car collision that was caused by a driver distracted on March 25, 2011 at 23:45. According to the Missouri Highway Patrol, Paul E. Johnson was not paying attention and did not realize that traffic had stopped in front of him on eastbound I-70. Johnson collided with a 2001 Chevrolet Tahoe and 2005 Nissan Armada before changing lanes and swiping two other cars, a 2008 Mercedes and a 2008 Saturn Astro before ending up in the median. Holland, who was driving the 2008 Mercedes, was the only Missouri car accident victim to report injuries. The Northeast Fire and EMS transported her to DePaul Hospital. The other drivers, LaAngela A. Tompkins, Bertha C. Himes, and John N. Wulf were not injured.

The National Highway Traffic Safety Administration (NHTSA) rates driver inattention as the main factor in most Missouri car accidents. In a research report done in conjunction with the Virginia Tech Transportation Institute, the NHTSA found that 80 percent of accidents involve driver inattention within three seconds before the event. Mobile phone use and drowsiness are the main causes of driver inattention. The study emphasized that conditions change quickly so drivers cannot predict when it is safe to look down from the road. Motorists should avoid driving distractions such as applying makeup or using mobile electronic devices while driving.

St. Louis Street Racing Accident Injures 17-Year-Old Girl

As a St. Louis car accident attorney, I was disappointed to read about a serious accident involving a 17-year-old girl and drag racing in St. Louis, Missouri. The teenage girl is still in serious condition at the St. Louis University Hospital after an illegal drag race got out of control.

In northern part of downtown in St. Louis, the teenage victim was acting as the “flag girl” for the drag race and was struck by the two vehicles racing. She was first hit by a Mitsubishi Eclipse, which sent her into the path of a truck. The Eclipse and truck were racing and took off after the 17-year-old was struck. Warrants have been issued for the arrest of the two drivers on charges for leaving the scene of an accident and vehicular assault. The bystanders of the drag race called 911 and attended to the victim’s injuries.

Drag racing is a dangerous sport because a motor vehicle could easily turn into a dangerous weapon if the driver is not careful. Pedestrians are in just as much danger as the drivers because a driver can easily lose control of a vehicle at a high speed. Racing and driving at an excessive speed are often considered to be negligent behavior and victims of these negligent behaviors have the right to file a civil lawsuit to receive compensation for their injuries.

I wanted to discuss this case because it highlights a little known aspect of Missouri injury law – joint venture.  In Missouri, not only can the person who actually caused the damage be held responsible, but so can all of the people involved.  Thus, both of the drivers were engaging in this joint venture of illegal drag racing.  Both can probably be held responsible.  Additionally, there may be others who are equally liable.  This would depend on how well organized the event is.  In cases like this, the most critical aspect is the discovery phase where the injury attorney gathers all the necessary facts and finds everyone who could possibly be held liable.  It’s not done to punish those involved, but rather it is more about finding all of the insurance coverage that could possibly apply.  This is especially true in cases like this where the young girl was seriously injured.

Pedestrians Struck Outside St. Louis Church By 85-Year-Old Driver
