A rear-end accident in Callaway County, Missouri on route J injured Shyan M. Clark from Fulton, Missouri. On May 17, 2011, 33-year-old James R. Allen was stopped in his 2003 Saturn behind another vehicle, which was also making a left turn. 55-year-old Deborah J. Roberts failed to stop her 2005 Lincoln resulting in a rear-end collision. Another vehicle, driven by 40-year-old Shelly Basnett struck Roberts vehicle resulting in a second strike to Allen’s vehicle. Another driver, Renee M. Knipfel, then collided with Basnett’s vehicle. The only reported injury was that of 12-year-old Shyan M. Clark who suffered moderate injuries and was taken to Callaway County Hospital by ambulance. She was not wearing a seat belt during the collision. Missouri law requires all children 15-years-old to wear a seat belt while in a moving vehicle. Children in Missouri are required to wear a seat belt regardless of where in the vehicle they are located. The Missouri child restraint laws are different than the seat belt laws for adults, which only require an adult wear a seat belt in the front seat. Law enforcement officers can pull over any vehicle where a child is not properly restrained with a safety belt. There are a few exemptions to the restraint law, which are parades and agricultural reasons. Missouri’s child safety belt law decreases the risk of injury and death for children involved in a motor vehicle accident. According to the Center for Disease Control and Prevention, nearly 184,000 children are injured in Missouri car accidents every year. Several studies indicate that seat belts greatly reduce the number of car accident injuries of children. The CDC recommends that all children under the age of 12 only sit in the back seat to avoid risk from air bags or dash impact. While on the road, you should always be safe. Wearing a seatbelt isn’t an option anymore even though law enforcement officers won’t pull someone over just because they are not wearing a seat belt. Even when you drive carefully, there are other people on the road that you can’t control and Missouri car accidents happen. If a negligent driver injures you, call 888.956.2487 to speak to an experienced Missouri motor vehicle accident attorney to discuss your claim and your rights as a victim. *************************************************** Joshua P. A car accident in Miller County, Missouri killed four people and injured two others on May 8, 2011. Murali Bottu, a 22-year-old resident of Rolla, Missouri, lost control of his Toyota Camry in the westbound lanes of MO-42. As a result of losing control, Bottu crossed the centerline and overcorrected his vehicle causing the vehicle to flip sideways. Darren J. Denter, the driver of a Chevrolet Silverado, struck Bottu’s flipped vehicle on the passenger side. The force of the impact pushed both vehicles off the road, totaling them. All the occupants of Bottu’s vehicle were residents of Rolla, Missouri, were killed in the car accident. 22-year-old Sri H. Chittury, 23-year-old Dheeraj Gudlawar, 21-year-old Srikanth Ravi, and 24-year-old Srupun Velumula, all originally from India were pronounced dead at the scene by the Miller County Coroner at 12:10 p.m. The driver of the Camry, Bottu, was seriously injured in the accident and was air lifted to the University of Missouri Hospital in Columbia for treatment. The driver of the Silverado, Denter, refused medical attention at the scene, but his passenger Robert E Davis was taken by ambulance to the Lake Regional Hospital in Osage Beach. When a death is caused by misconduct, negligence, or carelessness, it is considered a wrongful death. In Missouri, wrongful death statutes all family members to recover damages. If the accident victim was a passenger in the vehicle, his or her family can also sue the driver. If a foreign citizen is a victim in a Missouri car accident, family members can still receive compensation under the Missouri wrongful death statutes. If a loved one has passed away in a Missouri car accident at the negligence of another, an experienced attorney will understand how to properly file a wrongful death claim in Missouri. Call 888.956.2487 to speak to an experienced Missouri car accident attorney to ensure the rights of the victim and the family will be well represented. ******************************************************* Joshua P. Five residents from the towns of Fairdealing and Doniphan were injured in a car accident in Ripley County, Missouri on May 21, 2011. On Brooks Lane, three miles east of Doniphan in Ripley County, 51-year-old Sue K. Sanford made a U-turn in her 1998 Pontiac. As she was turning, 68-year-old James E. Bozeman’s 2002 Mitsubishi struck her. Sanford’s vehicle was totaled, and Bozeman’s vehicle received extensive damage in the car accident. A total of five people were injured in the Missouri accident. Sanford suffered from moderate injuries and her passenger Jonathan C. Wilkerson received minor injuries. Both were Doniphan residents and were taken by ambulance to Poplar Bluff Regional Medical Center. Another passenger of Sanford’s was 13-year-old Christin D. Sanford suffered serious injuries and was transported to St. Francis Medical Center in Cape Girardeau by Airevac. Bozeman and his passenger, Dorothy M. Bozeman, suffered minor injuries in the accident. The Fairdealing residents were transported by ambulance to Ripley County Memorial Hospital. Missouri accidents involving U-turns stress the importance of defensive driving. When the driver attempting the U-turn does not take into consideration the oncoming traffic speed or distance, it can be devastating. Drivers of oncoming traffic may not realize the type of turn being made and do not have enough time to adjust their speed or change lanes. Passive driving such as these examples increase the risks in Missouri car accidents. Missouri offers many defensive driving courses throughout the year to reduce the number of accidents related to passive driving by teaching drivers how to anticipate dangerous situations and avoid traffic collisions. Regular driver’s education courses offered in high schools usually only teach the basics of driving and rules of the road. Missouri defensive driving courses offer drivers the skills to go beyond the basic mechanics and prepare them for many different situations on the road. Basic driver’s education will discuss whether or not a U-turn is legal in certain situations, but a defensive driving course will teach how to react to an unexpected or illegal U-turn to avoid a Missouri car accident. All drivers should invest their time into a defensive driving course to better prepare them for many roadway situations. There are many ways a negligent driver can be dangerous on the road. When a driver does not pay attention or makes a dangerous decision, victims have to deal with the stress of the accident. Defensive driving courses can help you prepare for dangerous situations, but occasionally an accident is unavoidable. If you have been injured in a Missouri car accident, please consult an experienced car accident attorney immediately. Seeking legal counsel soon after an accident is essential to building a case against the negligent driver and having a defensive driving course may help you in your claim for compensation. Call 888.956.2487 to discuss your motor vehicle accident claim and let us investigate for you. ************************************************** Joshua P. A side-impact Missouri car accident occurred when 27-year-old Amber M. Lewis of Bixby, Missouri drove through a stop sign on Business 67 in Cherokee Pass. Lewis drove in to the path of 18-year-old Whitney N. Kemp of Fredericktown, Missouri. The Missouri car accident caused both vehicles to run off the road and down into an embankment. According to the Missouri State Highway Patrol, both vehicles caught fire in the accident. Both drivers were injured in the Missouri car accident and so were the passengers of both vehicles. Lewis suffered minor injuries, but her passenger Bruce E. Copeland of Bixby, Missouri, was moderately injured. Lewis & Copeland were taken to Madison Medical Middle in Fredericktown, Missouri by ambulance for treatment. It is reported that neither Lewis or Copeland were wearing a seat belt in the Missouri car accident. Kemp’s passenger, Robert D. Berry of Fredericktown, suffered serious injuries in the Missouri car accident. Kemp and Berry were taken to the Parkland Hospital in Farmington, Missouri for treatment. Missouri statute §304.271 requires drivers to abide by traffic-control instructions, which include stop signs. The only exemptions to the statute are authorized emergency vehicles. A driver who fails to stop at a stop sign violates the Missouri statute will most likely be charged with a class C misdemeanor. Statute violations can be used to prove a driver’s negligence in a Missouri car accident. A victim of a victorious negligence claim in a Missouri car accident will show that: (1) the driver owed a responsibility to the victim, (2) the driver violated that responsibility, (3) the negligent behavior was the cause of the injury to the victim, and (4) the Missouri car accident victim has sustained a loss as a result of the negligence and injury. Missouri Traffic statutes were established to protect the rights of the passengers, pedestrians, and others, which drivers owe. If the victim can prove with evidence that the defendant was negligent, the defendant must pay the victim compensation for injuries sustained. There are many ways a negligent driver can be dangerous on the road. When a driver does not pay attention or makes a dangerous decision, victims have to deal with the stress of the accident. One man was killed and another injured in a Missouri car accident when two F150s collided on Route H in Perry County Missouri on April 4, 2011. 39-year-old Michael Tomkins of Herrin, Illinois was driving on Route H when his wheel slipped off the roadway. Tomkins overcorrected his 1998 Ford F150, which caused him to slightly travel off the other side of the road. Cape Girardeau resident, 44-year-old James Buck tried to swerve his 2004 Ford F150 to miss Tomkins, but they collided. As a result, Buck’s truck overturned. The Assistant Coroner pronounced Tomkins dead at the scene of the accident at 8:45 am. Buck was taken to the Perry County Memorial Hospital by ambulance with moderate injuries. Both trucks were totaled and Tomkins was reportedly not wearing his safety belt. Missouri statute §307.178 requires that all drivers and passengers in the front seat wear a seat belt. Missouri safety advocates have repeatedly pushed to change the law. MoDOT and the state transportation director want lawmakers to change §307.178 to allow primary enforcement. Primary enforcement would allow law enforcement to pull over cars in which some is not wearing a seatbelt. Safety advocates additionally want the law to require all passengers to wear a safety belt, not just front seat passengers. While on the road, you should always be safe. Wearing a seatbelt isn’t an option anymore even though law enforcement officers won’t pull someone over just because they are not wearing a seat belt. Even when you drive carefully, there are other people on the road that you can’t control and Missouri motor vehicle accidents happen. When you are injured in an auto accident, you have a lot to handle. Treatment and recovery can be stressful enough combined with lost wages and being unable to work. As a Missouri car accident attorney, I urge you to not wait too long to file a personal injury claim after the car accident. Many people believe they have plenty of time after an accident, but there are two factors that car accident victims need to be aware of when it comes to time. The first time constraint will be the law. The statute of limitations for personal injury claims in Missouri is five years. This means you have five years from the date of injury to bring a case against the person or company liable for the injuries. Don’t put off your personal injury claim for too long because after the statute of limitations is up, there is no way to receive compensation for your injuries. The second time constraint and most inconvenient will be the insurance company. Soon after the accident, the insurance company will try to get you to give them a statement of the accident. I always suggest that my clients NOT give a statement to the insurance company because it could prevent you from receiving the full compensation you deserve. The insurance adjuster will also try to get you to accept a small settlement offer in order to clear it up quickly. If you take this settlement that is all that you will receive regardless if it doesn’t cover treatment needed in the future. If you have been injured in a car accident, please contact a Missouri car accident attorney right away. The insurance adjuster may try to talk you out of an attorney, but he or she does not have your best interest in mind. When it comes to a motor vehicle accident that results in personal injury, insurance companies will do what they can to reduce the amount of money they have to pay out to the injured. Call 888.956.2487 to speak to an experienced Missouri car accident attorney and discuss your rights. Joshua P. Myers is the owner and President of Myers Injury Law, LLC and a founding partner of Schultz & Myers, LLC. When you are in a car accident that results in serious injuries, receiving compensation for your injuries can seem out of reach. With a top Missouri car accident lawyer on your team, your compensation is well within reach. Just ask Marilyn Leach of St. Charles, Missouri who recently settled her personal injury claim against another motorist for $1.15 million. Marilyn Leach was severely injured when 17-year-old Cody Bernat crossed the centerline of the road speeding 50 mph in a 25 mph zone. When the vehicles collided head-on, Bernat and his passengers were not seriously injured, but Leach was a different story. Marilyn Leach suffered severe knee and pelvis fractures when her lower body was flattened under the dashboard and her upper body hit the steering wheel with such force that it broke in half. Leach required several surgeries to repair her injuries and now requires the use of a cane to walk. Before the accident she was the assistant manager of a fast food restaurant, but afterwards she was no longer able to work. Leech was left without a job and had no health insurance to cover her medical bills, so she filed a personal injury claim. Cody Bernat was covered by his father’s umbrella policy that was $1 million. When a negligent driver causes serious injury to you or a family member, the stress of it all can be overwhelming. Filing a personal injury claim will help pay the medical expenses and compensate you for your lost wages. Marilyn Leech is able to walk because of medical advances and luck, but it wasn’t luck that was on her side when she won her motor vehicle accident settlement. Leech had an experienced accident attorney on her side, fighting for her rights as a victim of vehicular negligence. If you have been injured in a car accident, you are not alone. Our experienced St. Louis car accident attorneys are here to help you through this difficult process. Call 888.956.2487 for a free consultation and let us fight for you. Joshua P.
