A Car Chase in Taney County, Missouri Ends in a Head-on Collision

A multiple vehicle car accident and three injured Missourians was the result of a car chase in Taney County. On June 4, 2011 around 8:10 p.m. on Route F close to Branson, Missouri Bernard H. Johnson was pursuing Benjamin K. Sanders. The accident occurred as Sanders drove his 1982 Honda Gold Wing on Route F as Johnson chased him in his 2004 Ford Crown Victoria. During the pursuit, Sanders crossed the centerline of the road and hit Jodi M. Ebersol’s 1997 Ford Taurus head on. The force of that head-on collision pushed Ebersol into another head-on collision with Johnson’s vehicle. All vehicles involved in the accident were totaled. 37-year old Ebersol received serious injuries in the accident. 31-year-old suffered moderate injuries and 69-year-old Johnson only suffered minor injuries in the Missouri car accident. It is unclear why Johnson was pursuing Sanders in the first place.

A Chain Reaction Car Accident in Newton County Injures Six People

A Missouri car accident in Newton County injures six people from Granby and Monett. The Missouri car accident occurred on US 60 just three miles east of Granby at 6:45 p.m. on June 6, 2011. Just before the accident, Pam L. Sternes of Granby, Missouri waited to make a left turn in her 2002 Ford Windstar. Matthew D. Tucker of Neosho, Missouri was unable to stop his 1997 Volkswagen Jetta and rear-ended Sternes’ van. The collision forced Sternes’ van into oncoming traffic resulting in a head-on collision with Sharrie L. Harman of Monett, Missouri. Harman’s 2006 Dodge Charger along with the other vehicles involved in the accident was totaled.

Two drivers, Hartman and Sternes, were seriously injured in the Missouri car accident. Hartman was taken to Cox South Hospital in Springfield, Missouri and Sternes was taken to Freeman West Hospital in Joplin, Missouri. Four other injuries were reported from the minors that occupied Sternes’ Windstar: 10-year-old Nathan C. Sternes, 12-year-old Lauren Sternes, 13-year-old Kyle A. Sternes, and 14-year-old Cotton C. Jones. It is unknown the extent of the minors’ injuries.

In Missouri car accidents, governed by state tort law, injured individuals should receive compensation. Missouri tort laws allow victims of car accidents to recover losses caused by the at-fault driver and their insurance company. Syreeta A. Holland is at DePaul hospital after being injured in a Missouri rear-end car collision that was caused by a driver distracted on March 25, 2011 at 23:45. According to the Missouri Highway Patrol, Paul E. Johnson was not paying attention and did not realize that traffic had stopped in front of him on eastbound I-70. Johnson collided with a 2001 Chevrolet Tahoe and 2005 Nissan Armada before changing lanes and swiping two other cars, a 2008 Mercedes and a 2008 Saturn Astro before ending up in the median. Holland, who was driving the 2008 Mercedes, was the only Missouri car accident victim to report injuries. The Northeast Fire and EMS transported her to DePaul Hospital. The other drivers, LaAngela A. Tompkins, Bertha C. Himes, and John N. Wulf were not injured.

The National Highway Traffic Safety Administration (NHTSA) rates driver inattention as the main factor in most Missouri car accidents. In a research report done in conjunction with the Virginia Tech Transportation Institute, the NHTSA found that 80 percent of accidents involve driver inattention within three seconds before the event. Mobile phone use and drowsiness are the main causes of driver inattention. The study emphasized that conditions change quickly so drivers cannot predict when it is safe to look down from the road. Motorists should avoid driving distractions such as applying makeup or using mobile electronic devices while driving.

St. Louis Street Racing Accident Injures 17-Year-Old Girl

St. Louis Street Car Racing AccidentTeenagers are risk takers and sometimes it can be dangerous, especially when a risk involves a motor vehicle. As a St. Louis car accident attorney, I was disappointed to read about a serious accident involving a 17-year-old girl and drag racing in St. Louis, Missouri. The teenage girl is still in serious condition at the St. Louis University Hospital after an illegal drag race got out of control.

In northern part of downtown in St. Louis, the teenage victim was acting as the “flag girl” for the drag race and was struck by the two vehicles racing. She was first hit by a Mitsubishi Eclipse, which sent her into the path of a truck. The Eclipse and truck were racing and took off after the 17-year-old was struck. Warrants have been issued for the arrest of the two drivers on charges for leaving the scene of an accident and vehicular assault. The bystanders of the drag race called 911 and attended to the victim’s injuries.

Drag racing is a dangerous sport because a motor vehicle could easily turn into a dangerous weapon if the driver is not careful. Pedestrians are in just as much danger as the drivers because a driver can easily lose control of a vehicle at a high speed. Racing and driving at an excessive speed are often considered to be negligent behavior and victims of these negligent behaviors have the right to file a civil lawsuit to receive compensation for their injuries.

Missouri Accident Lawyer Says Drugged Driving Needs More Study & Attention

There is a lot of information available for alcohol-related car accidents, but very little information on drug-related car accidents.

A new National Highway Traffic Safety Administration (NHTSA) report on drug use in fatal car accidents was released. There have been numerous studies on how alcohol contributes to fatal car accidents, but this is the first study that addresses the issue of drug impairment contributions to car accidents. The study only focused on accidents that resulted in a fatality, but it verifies that more effort needs to be put into training officers of the law to spot drug impairment. According to the 2009 study, 21,798 were killed in a motor vehicle accident. Of the fatalities, 13,750 were test for drug use by the NHTSA. Out of the fatalities tested for drugs, 3,952 drivers tested positive for a narcotic at the time of the crash.

The data may show a strong correlation between alcohol and car accidents, but more studies need to be done to have conclusive evidence that drug impairment has the same correlation. As an effort to gather more information, over 6,000 law enforcement officers from 46 states have trained to recognize a driver who is impaired by both drugs and alcohol. Uninsured Driver Causes Camden County Car Accident

Staying alert on the road is important for the safety of everyone. When a driver is not paying attention, the result can be fatal. As a Missouri car accident attorney, I was bothered to read about a head-on collision caused by an uninsured driver in Linn Creek, Missouri that sent a woman to the hospital with serious injuries.

On January 3, 2011, around 4:45 p.m. the collision occurred on HIghway 54 in Camden County, Missouri, that caused serious and moderate injuries to two people. Kimberly Scott of Linn Creek, Missouri, was driving a 2009 Toyota eastbound on U.S. Highway 54 about a mile west of Route AA. At that time and place, Steven Owens of Macks Creek, Missouri, was the driving westbound on Highway 54 in a 1998 Ford. Owens crossed the centerline and collided head-on with Scott. The impact caused Scott’s Toyota to cross the centerline, where she was hit by another westbound vehicle.

Kimberly Scott had serious injuries and was transported by ambulance to Lake Regional Hospital. At-fault driver, Steven Owens, had moderate injuries and was also transported by ambulance to Lake Regional Hospital. The third driver of the vehicle unharmed. The motor vehicles of Kimberly Scott and Steven Owens were totaled from the accident, and the third vehicle only had moderate damage. Steven Owens did not have auto insurance.

This crash highlights the importance of having uninsured motorist coverage.  This is a type of coverage that each person carriers on their own automobile insurance whether they know it or not.  When the driver who hits you is uninsured, or it’s a hit and run accident, then your insurance company acts as if it was the insurance company for the person responsible for your injuries.  Unfortunately, this often means that they will try and low-ball you just as the other person’s car insurance would do.  However, the added protection you have in these cases, is that, if your insurance company will not be fair, they can be sued not only for your injuries, but also under a little-known Missouri law called vexatious refusal to pay.  This allows you to ask a jury, not only for compensation for your injuries, but also for penalties and attorney’s fees for the way the insurance company handled your claim.  This is one of my favorite types of cases because insurance companies are never fair and it is satisfying to be able to expose their tactics to a jury.

Five People Injured In St. Louis, MO Train Accident

Two people were injured in the vehicle and three people on the train were injured. According to the officials and the Belleville News Democrat, the driver of the vehicle apparently was lost after crossing the railway, turned around and crossed the tracks again in front of the train.

Police said that in the early stages of their investigation that the stop arm was working properly. Victims of train accidents are often severely or fatally injured due to the speed and sheer speed of the train. It is rare that the crossbars or flashing lights do not working properly. It is always important to slow down when arriving at a railway crossing and stop and look both ways.

Drunk Driving Accident Results In Death of Belleville, IL Man

The driver of the Neon, an 18-year-old Belleville man was taken to the hospital with serious injuries. The passenger of the Neon was not wearing his seatbelt and was ejected from the vehicle. The 21-year-old from Fairview Heights was also taken to the hospital for serious injuries.

When the head-on collision occurred, the engine block of the Neon became detached and hit a Dodge Ram truck driving by a 22-year-old man from Belleville. The driver of the Ram was not injured. According to authorities, the 18-year-old driver of the Neon was under the influence of alcohol and a full investigation is in progress. Unrelated Medical Conditions Should Not Be Admissible In Missouri Car Accident Cases

Missouri Car Accident AttorneyWhen a person is injured in a Missouri motor vehicle accident, their life turns upside down as they receive treatment for their injuries and begin to recover. As a Missouri car accident attorney, I know how difficult a civil lawsuit can be for accident victims, but the challenge is usually worth it in the end. A lot of potential clients ask me how difficult it is to receive compensation for an injury, if they have unrelated medical conditions or unrelated medical treatment. The answer is not always so simple.

Plaintiff lawyers do what they can to keep certain evidence from being heard by a jury such as unrelated medical issues. Unrelated medical treatment can be damaging to a motor vehicle accident victim, but it is not always relevant to the accident in question. I see many defense attorneys try to bring up a Missouri motor vehicle accident victim’s unrelated injuries to convince a jury to award a lower compensation amount.

In the Missouri civil case, Senter v. Ferguson, the court allowed the defense attorney to question the Plaintiff about her unrelated injuries that she sustained many years before the motor vehicle accident. The defense argued that the unrelated medical condition was relevant to the case because the Plaintiff said she was in “good health” before the accident occurred. The appellate court of Missouri reversed the motor vehicle accident injury case partially because the Plaintiff’s prior condition was unrelated to her condition after the accident.

The Missouri appellate court said, “While we are dubious that this evidence, stretching as it did over a period of seventeen years and covering the ages of 43 to 60, served its purpose of impeachment, we could not sanction its admission even if it did serve the purpose. Irrelevant and immaterial evidence does not become admissible simply to impeach a witness.” This means that even though the medical condition did affect the Plaintiff for a period of time in her life, but the condition did not contribute to the injuries sustained in the Missouri motor vehicle accident.

Missouri Highway Patrol Seeking To Reduce Car Accidents
