Single Missouri Car Accident in Gasconade County Claims Life

The Missouri car accident occurred on July 29, 2011 as 51-year-old Diana L. Czeschin crossed the centerline near Red Bird Road on Route B. When Czeschin attempted to correct her 1995 GMC truck, she overcorrected and traveled off the right side of the road. The Bland, Missouri resident crashed into a tree and was pronounced dead by, Ben Grossman, the Gasconade County Coroner. Czeschin was not wearing her seatbelt during the Missouri car accident.

St. Charles County Car Accident Causes O’Fallon Man to be Ejected

An O’Fallon, Missouri man was hospitalized after a car accident in St. Charles County, Missouri. The Missouri car accident happened on I-64 on July 19,2011. Wright City resident, Erin N. Dorlaque, drove her 2005 Cadillac into the rear of Michael W. Huffman’s 2002 Ford Expedition while traveling eastbound on I-64. The force of the collision caused both vehicles to drive off the road and rollover. As a result of the Missouri car accident, Huffman was ejected from his vehicle. Huffman was taken to St. John’s Medical Center by St. Charles County Ambulance to be treated for serious injuries.

Missouri Rear-end Traffic Accident in Callaway County Leaves 12-year-old Injured

A rear-end accident in Callaway County, Missouri on route J injured Shyan M. Clark from Fulton, Missouri. On May 17, 2011, 33-year-old James R. Allen was stopped in his 2003 Saturn behind another vehicle, which was also making a left turn. 55-year-old Deborah J. Roberts failed to stop her 2005 Lincoln resulting in a rear-end collision. Another vehicle, driven by 40-year-old Shelly Basnett struck Roberts vehicle resulting in a second strike to Allen’s vehicle. Another driver, Renee M. Knipfel, then collided with Basnett’s vehicle. The only reported injury was that of 12-year-old Shyan M. Clark who suffered moderate injuries and was taken to Callaway County Hospital by ambulance. She was not wearing a seat belt during the collision.

Missouri law requires all children 15-years-old to wear a seat belt while in a moving vehicle. Children in Missouri are required to wear a seat belt regardless of where in the vehicle they are located. The Missouri child restraint laws are different than the seat belt laws for adults, which only require an adult wear a seat belt in the front seat. Law enforcement officers can pull over any vehicle where a child is not properly restrained with a safety belt. There are a few exemptions to the restraint law, which are parades and agricultural reasons.

One Dead and Seven Injured in Missouri Rear-end Collision

A rear-end car accident in Jefferson County, Missouri killed a teenager and injured seven people on May 1, 2011. The accident happened as a Chevrolet Impala driven by Michael A. Rayfield from Fetus, Missouri and a Ford Escort driven by Holly J. Duncan were stopped at a red light in the southbound lanes of US-67 at the cross intersection of Meyer Road. A Pontiac G8, driven by Daniel B. Torrence, failed to stop crashing into the rear of Duncan’s vehicle. The force of the collision caused Duncan’s Ford to rear-end Rayfield’s vehicle.

Unfortunately, 15-year-old Thomas A. Duncan from Bonne Terre, Missouri died after being transported to St. John’s Mercy Medical Center in Creve Coeur and than being airlifted to the Children’s Hospital. Seven other Missouri residents were also injured in the rear-end collision. Joshua Duncan, 9-years-old, was seriously injured along with 14-year-old Caleb Reed. The minors were transported to Cardinal Glennon Hospital by the Arch Helicopter transport. 39-year-old Holly Duncan, 11-year-old Paul Duncan, 37-year-old Daniel Torrence, and 14-year-old Blaise Torrence sustained minor injuries and taken to Jefferson Regional Medical Center by Joachim Plattin Ambulance.

Missouri Car Accident Attorney Stresses Need for Defensive Driving

Five residents from the towns of Fairdealing and Doniphan were injured in a car accident in Ripley County, Missouri on May 21, 2011. On Brooks Lane, three miles east of Doniphan in Ripley County, 51-year-old Sue K. Sanford made a U-turn in her 1998 Pontiac. As she was turning, 68-year-old James E. Sanford suffered from moderate injuries and her passenger Jonathan C. Wilkerson received minor injuries. Both were Doniphan residents and were taken by ambulance to Poplar Bluff Regional Medical Center. Another passenger of Sanford’s was 13-year-old Christin D. Sanford suffered serious injuries and was transported to St. Francis Medical Center in Cape Girardeau by Airevac.

Bozeman and his passenger, Dorothy M. Bozeman, suffered minor injuries in the accident. The Fairdealing residents were transported by ambulance to Ripley County Memorial Hospital. Seven Injured in Cass County, Missouri on Independence Day

A multivehicle Missouri car accident on Independence Day leaves seven young adults injured. The car accident occurred at 1:30 a.m. in Cass County, Missouri on MO-58 just east of Prairie Lane. The multivehicle Missouri car accident began as 18-year-old Brandyn P. Stewart’s 2003 Pontiac Grand AM struck the rear of 21-year-old Jereth D. Schrock’s 2000 Ford Mustang. The force of the accident caused Schrock’s vehicle to pull off the right side of the road into a nearby field.

Stewart’s vehicle continued down the road and made its way across the centerline. Stewart hit 18-year-old Trevor D. Williams’ 2003 Dodge 1500 head-on. Williams’ vehicle rolled several times until it stopped off the highway. A total of seven people were injured in the multivehicle Missouri car accident. Trevor D. Williams and his passengers, 18-year-old Joshua A. Ogan, and 17-year-old Taylor N. Hood, were seriously injured in the accident. Jereth D. Schrock and one of his passengers, 20-year-old Emily K. Warren sustained moderate injuries. His other passenger, 18-year-old Jaque J. Willis sustained only minor injuries.

The young adults injured in the multivehicle Missouri car accident were taken to local hospitals Truman Medical Center, Research Hospital, Overland Park Regional, and KU Medical Center by Belton EMS, South Metro EMS, Lifeflight Eagle, and a private vehicle. The accident report did not specify whether or not alcohol played a role in the accident. Holiday celebrations increase the risk of alcohol-related accident since many festivities include drinking. Missouri Head-on Collision Leaves Four Injured Including a One-year-old

A Missouri head-on car accident on April 18, 2011 left four Missourians including a small child in Lafayette County, Missouri injured. The vehicles involved in the head-on collision were driving in opposite directions along the center line of Rolling Hill a little further east of MO-213. A 2004 Hyundai driven by 23-year-old Melanie R. Dysart of Dover, Missouri was traveling eastbound in the center of the road. A 1989 Nissan driven by 19-year-old Tiffany R. Earnest of Higginsville, Missouri was traveling westbound, also in the center of the road. The two vehicles crashed on a hill.

Most of the victims in the Missouri head-on collision were not wearing their safety belts. Tiffany Earnest suffered serious injuries and was taken to the Research Medical Center in Kansas City, Missouri by Higginsville E.M.S. Tiffany Earnest’s passenger, 22-year-old Gary J. Earnest was also seriously injured in the Missouri head-on collision and taken to Truman Medical Center by Lifelight Eagle air ambulance. Melanie Dysart was moderately injured in the Missouri car accident and was taken to Centerpoint Hospital by Higginsville E.M.S. Considering the severity of the Missouri head-on collision, one-year-old Tilian Sinkler only suffered minor injuries from the accident. Fortunately, the toddler was the only passenger in the accident to be secured properly by a safety belt.

Missouri Car Accident Claims One Life and Leaves Another Injured

One man was killed and another injured in a Missouri car accident when two F150s collided on Route H in Perry County Missouri on April 4, 2011. 39-year-old Michael Tomkins of Herrin, Illinois was driving on Route H when his wheel slipped off the roadway. Tomkins overcorrected his 1998 Ford F150, which caused him to slightly travel off the other side of the road. Cape Girardeau resident, 44-year-old James Buck tried to swerve his 2004 Ford F150 to miss Tomkins, but they collided. As a result, Buck’s truck overturned.

The Assistant Coroner pronounced Tomkins dead at the scene of the accident at 8:45 am. Buck was taken to the Perry County Memorial Hospital by ambulance with moderate injuries. Both trucks were totaled and Tomkins was reportedly not wearing his safety belt. Missouri statute §307.178 requires that all drivers and passengers in the front seat wear a seat belt. Missouri safety advocates have repeatedly pushed to change the law. MoDOT and the state transportation director want lawmakers to change §307.178 to allow primary enforcement. Primary enforcement would allow law enforcement to pull over cars in which some is not wearing a seatbelt. Safety advocates additionally want the law to require all passengers to wear a safety belt, not just front seat passengers.

Two People Killed in Stoddard County, Missouri Car Accident

Two residents from Marston, Missouri were killed over the holiday weekend. The fatal car accident happened at Morehouse on US-60 and MO-114. The Missouri car accident happened as Charlie S. Hammons pulled his 1998 Ford into the pat of Bryian G. Brown’s 1996 Chevrolet. Brown’s vehicle slammed in to Hammons’ vehicle, which pushed both vehicles off the road. Although all occupants in Hammond’s vehicle were wearing seatbelts, Hammond’s was ejected from the Ford.

Hammons was taken to St. Francis Hospital for medical treatment by Air Evac, but the 93-year-old was pronounced dead by the Cape Girardeau Coroner. Essie P. Hammons, the 87-year-old occupant of Hammons, was pronounced dead at the scene of the Missouri car accident by Stoddard County Coroner. The only survivor in the Ford was a teenager. George D. Brown of New Madrid, Missouri suffered moderate injuries and was taken to Missouri Delta Medical Center by ambulance.

In the event of a Missouri car accident that results in the death of the at-fault driver, many injured victims wonder how they will recover damages. The ability to sue an at-fault driver even after his or her death depends on whether or not the jurisdiction has passed a law called a survival statute. Survival statutes determine that a personal injury case will survive even if the at-fault party does not.

Missouri’s survival statute is Missouri statute §537.020. This statute states that the cause of action for personal injuries “shall not abate” because the at-fault party has passed away. A Three-car Accident Injures Two in Johnson County, Missouri

A car accident in Johnson County, Missouri leaves a teen from Lee’s Summit seriously injured. A woman from Ohio was also injured in the multivehicle car accident, which occurred at 4:20 p.m. on MO-10 on June 13, 2011. Lee’s Summit resident, 17-year-old Jackson J. Hill, attempted to pass the 2003 Chevrolet driven by Angela D. Hardy of Warrensburg. In the process of passing in his 2002 Honda, Hill clipped the left rear corner of Hardy’s vehicle. After colliding with Hardy’s Chevrolet, Hill collided with a 1997 Honda driven by John M. Gallagher from Independence. As a result of the multivehicle accident, Hill was ejected from his vehicle. Hill sustained serious injuries and was transported to Research Hospital in Kansas City, Missouri by LifeFlight EMS. A passenger of Gallagher’s vehicle, Tammy S. Mahan from Ohio, was taken by Johnson County EMS to Centerpoint Hospital in Independence, Missouri for treatment. The Missouri Highway Patrol reported that an investigation into the accident has been launched and that charges are pending.
