A rear-end accident in Callaway County, Missouri on route J injured Shyan M. Clark from Fulton, Missouri. On May 17, 2011, 33-year-old James R. Allen was stopped in his 2003 Saturn behind another vehicle, which was also making a left turn. 55-year-old Deborah J. Roberts failed to stop her 2005 Lincoln resulting in a rear-end collision. Another vehicle, driven by 40-year-old Shelly Basnett struck Roberts vehicle resulting in a second strike to Allen’s vehicle. Another driver, Renee M. Knipfel, then collided with Basnett’s vehicle. The only reported injury was that of 12-year-old Shyan M. Clark who suffered moderate injuries and was taken to Callaway County Hospital by ambulance. She was not wearing a seat belt during the collision. Missouri law requires all children 15-years-old to wear a seat belt while in a moving vehicle. Children in Missouri are required to wear a seat belt regardless of where in the vehicle they are located. The Missouri child restraint laws are different than the seat belt laws for adults, which only require an adult wear a seat belt in the front seat. Law enforcement officers can pull over any vehicle where a child is not properly restrained with a safety belt. There are a few exemptions to the restraint law, which are parades and agricultural reasons. A rear-end car accident in Jefferson County, Missouri killed a teenager and injured seven people on May 1, 2011. The accident happened as a Chevrolet Impala driven by Michael A. Rayfield from Fetus, Missouri and a Ford Escort driven by Holly J. Duncan were stopped at a red light in the southbound lanes of US-67 at the cross intersection of Meyer Road. A Pontiac G8, driven by Daniel B. Torrence, failed to stop crashing into the rear of Duncan’s vehicle. The force of the collision caused Duncan’s Ford to rear-end Rayfield’s vehicle. Unfortunately, 15-year-old Thomas A. Duncan from Bonne Terre, Missouri died after being transported to St. John’s Mercy Medical Center in Creve Coeur and than being airlifted to the Children’s Hospital. Seven other Missouri residents were also injured in the rear-end collision. Joshua Duncan, 9-years-old, was seriously injured along with 14-year-old Caleb Reed. The minors were transported to Cardinal Glennon Hospital by the Arch Helicopter transport. 39-year-old Holly Duncan, 11-year-old Paul Duncan, 37-year-old Daniel Torrence, and 14-year-old Blaise Torrence sustained minor injuries and taken to Jefferson Regional Medical Center by Joachim Plattin Ambulance. A car accident in Miller County, Missouri killed four people and injured two others on May 8, 2011. Murali Bottu, a 22-year-old resident of Rolla, Missouri, lost control of his Toyota Camry in the westbound lanes of MO-42. As a result of losing control, Bottu crossed the centerline and overcorrected his vehicle causing the vehicle to flip sideways. Darren J. Denter, the driver of a Chevrolet Silverado, struck Bottu’s flipped vehicle on the passenger side. The force of the impact pushed both vehicles off the road, totaling them. All the occupants of Bottu’s vehicle were residents of Rolla, Missouri, were killed in the car accident. 22-year-old Sri H. Chittury, 23-year-old Dheeraj Gudlawar, 21-year-old Srikanth Ravi, and 24-year-old Srupun Velumula, all originally from India were pronounced dead at the scene by the Miller County Coroner at 12:10 p.m. The driver of the Camry, Bottu, was seriously injured in the accident and was air lifted to the University of Missouri Hospital in Columbia for treatment. The driver of the Silverado, Denter, refused medical attention at the scene, but his passenger Robert E Davis was taken by ambulance to the Lake Regional Hospital in Osage Beach. Five residents from the towns of Fairdealing and Doniphan were injured in a car accident in Ripley County, Missouri on May 21, 2011. On Brooks Lane, three miles east of Doniphan in Ripley County, 51-year-old Sue K. Sanford made a U-turn in her 1998 Pontiac. As she was turning, 68-year-old James E. Bozeman’s 2002 Mitsubishi struck her. Sanford’s vehicle was totaled, and Bozeman’s vehicle received extensive damage in the car accident. A total of five people were injured in the Missouri accident. Sanford suffered from moderate injuries and her passenger Jonathan C. Wilkerson received minor injuries. A Missouri head-on car accident on April 18, 2011 left four Missourians including a small child in Lafayette County, Missouri injured. The vehicles involved in the head-on collision were driving in opposite directions along the center line of Rolling Hill a little further east of MO-213. A 2004 Hyundai driven by 23-year-old Melanie R. Dysart of Dover, Missouri was traveling eastbound in the center of the road. A 1989 Nissan driven by 19-year-old Tiffany R. Earnest of Higginsville, Missouri was traveling westbound, also in the center of the road. The two vehicles crashed on a hill. Most of the victims in the Missouri head-on collision were not wearing their safety belts. Tiffany Earnest suffered serious injuries and was taken to the Research Medical Center in Kansas City, Missouri by Higginsville E.M.S. Tiffany Earnest’s passenger, 22-year-old Gary J. Earnest was also seriously injured in the Missouri head-on collision and taken to Truman Medical Center by Lifelight Eagle air ambulance. Melanie Dysart was moderately injured in the Missouri car accident and was taken to Centerpoint Hospital by Higginsville E.M.S. Considering the severity of the Missouri head-on collision, one-year-old Tilian Sinkler only suffered minor injuries from the accident. Two men were transported to Warrensburg hospital with moderate injuries after another vehicle lost control and forced their vehicle on the road. As a Missouri car accident lawyer, I was happy to hear that the victims would survive from their injuries. On January 24, 2011, at approximately 5:50, 77-year-old John Johnson was driving his 2009 Toyota Corolla westbound on U.S. Highway 50 with his passenger, 65-year-old Robert Rochenderfer when they were forced from the road. At the same time and place, 25-year-old Kristine Norton was traveling south on County Road NW 1751st. When Ms. Norton attempted to stop at a stop sign, she slid on the ice-covered roadway. She then traveled into the west lane of U.S. Highway 50 and struck the Mr. Johnson’s vehicle. This collision caused Mr. Johnson to lose control and leave the right side of the roadway where it struck a ditch and overturned. Mr. Johnson and Mr. Rochenderfer were taken by Johnson County Ambulance to St. Luke’s East with moderate injuries. The overturned vehicle was towed from the scene, by Ron’s trailer. The at-fault driver was not injured and was able to drive her car away from the scene of the accident. All drivers and occupants involved in the crash were wearing safety devices. This case reminds me of several I have handled in the past. The insurance companies will often try and argue that the responsible driver was not really negligent. Rather, they will argue it was an unavoidable collision because of the ice. This is hogwash. People are required to consider the conditions of the road when they drive. When the streets have snow and ice on them, we are required to drive more appropriately for the conditions. Teenagers are risk takers and sometimes it can be dangerous, especially when a risk involves a motor vehicle. Pedestrians are in just as much danger as the drivers because a driver can easily lose control of a vehicle at a high speed. Drivers know how dangerous it is to combine alcohol or drugs with driving, but still many lives are lost each year to the combination. A new National Highway Traffic Safety Administration (NHTSA) report on drug use in fatal car accidents was released. There have been numerous studies on how alcohol contributes to fatal car accidents, but this is the first study that addresses the issue of drug impairment contributions to car accidents. The study only focused on accidents that resulted in a fatality, but it verifies that more effort needs to be put into training officers of the law to spot drug impairment. According to the 2009 study, 21,798 were killed in a motor vehicle accident. Of the fatalities, 13,750 were test for drug use by the NHTSA. Out of the fatalities tested for drugs, 3,952 drivers tested positive for a narcotic at the time of the crash. The data may show a strong correlation between alcohol and car accidents, but more studies need to be done to have conclusive evidence that drug impairment has the same correlation. As an effort to gather more information, over 6,000 law enforcement officers from 46 states have trained to recognize a driver who is impaired by both drugs and alcohol.  Kimberly Scott Car Accident Staying alert on the road is important for the safety of everyone. When a driver is not paying attention, the result can be fatal. As a Missouri car accident attorney, I was bothered to read about a head-on collision caused by an uninsured driver in Linn Creek, Missouri that sent a woman to the hospital with serious injuries. On January 3, 2011, around 4:45 p.m. the collision occurred on HIghway 54 in Camden County, Missouri, that caused serious and moderate injuries to two people. Kimberly Scott of Linn Creek, Missouri, was driving a 2009 Toyota eastbound on U.S. Highway 54 about a mile west of Route AA. At that time and place, Steven Owens of Macks Creek, Missouri, was the driving westbound on Highway 54 in a 1998 Ford. Owens crossed the centerline and collided head-on with Scott. The impact caused Scott’s Toyota to cross the centerline, where she was hit by another westbound vehicle. Kimberly Scott had serious injuries and was transported by ambulance to Lake Regional Hospital. At-fault driver, Steven Owens, had moderate injuries and was also transported by ambulance to Lake Regional Hospital. The third driver of the vehicle unharmed. The motor vehicles of Kimberly Scott and Steven Owens were totaled from the accident, and the third vehicle only had moderate damage. Steven Owens did not have auto insurance. This crash highlights the importance of having uninsured motorist coverage. This is a type of coverage that each person carriers on their own automobile insurance whether they know it or not.
