Five residents from the towns of Fairdealing and Doniphan were injured in a car accident in Ripley County, Missouri on May 21, 2011. On Brooks Lane, three miles east of Doniphan in Ripley County, 51-year-old Sue K. Sanford made a U-turn in her 1998 Pontiac. As she was turning, 68-year-old James E. Bozeman’s 2002 Mitsubishi struck her. Sanford’s vehicle was totaled, and Bozeman’s vehicle received extensive damage in the car accident. A total of five people were injured in the Missouri accident. Sanford suffered from moderate injuries and her passenger Jonathan C. Wilkerson received minor injuries. Both were Doniphan residents and were taken by ambulance to Poplar Bluff Regional Medical Center. Another passenger of Sanford’s was 13-year-old Christin D. Sanford suffered serious injuries and was transported to St. Francis Medical Center in Cape Girardeau by Airevac. Bozeman and his passenger, Dorothy M. Bozeman, suffered minor injuries in the accident. The Fairdealing residents were transported by ambulance to Ripley County Memorial Hospital. Missouri accidents involving U-turns stress the importance of defensive driving. When the driver attempting the U-turn does not take into consideration the oncoming traffic speed or distance, it can be devastating. Drivers of oncoming traffic may not realize the type of turn being made and do not have enough time to adjust their speed or change lanes. Passive driving such as these examples increase the risks in Missouri car accidents. Missouri offers many defensive driving courses throughout the year to reduce the number of accidents related to passive driving by teaching drivers how to anticipate dangerous situations and avoid traffic collisions. Regular driver’s education courses offered in high schools usually only teach the basics of driving and rules of the road. Missouri defensive driving courses offer drivers the skills to go beyond the basic mechanics and prepare them for many different situations on the road. Basic driver’s education will discuss whether or not a U-turn is legal in certain situations, but a defensive driving course will teach how to react to an unexpected or illegal U-turn to avoid a Missouri car accident. All drivers should invest their time into a defensive driving course to better prepare them for many roadway situations. There are many ways a negligent driver can be dangerous on the road. When a driver does not pay attention or makes a dangerous decision, victims have to deal with the stress of the accident. Defensive driving courses can help you prepare for dangerous situations, but occasionally an accident is unavoidable. If you have been injured in a Missouri car accident, please consult an experienced car accident attorney immediately. Seeking legal counsel soon after an accident is essential to building a case against the negligent driver and having a defensive driving course may help you in your claim for compensation. Call 888.956.2487 to discuss your motor vehicle accident claim and let us investigate for you. ************************************************** Joshua P. A multivehicle Missouri car accident on Independence Day leaves seven young adults injured. The car accident occurred at 1:30 a.m. in Cass County, Missouri on MO-58 just east of Prairie Lane. The multivehicle Missouri car accident began as 18-year-old Brandyn P. Stewart’s 2003 Pontiac Grand AM struck the rear of 21-year-old Jereth D. Schrock’s 2000 Ford Mustang. The force of the accident caused Schrock’s vehicle to pull off the right side of the road into a nearby field. Stewart’s vehicle continued down the road and made its way across the centerline. Stewart hit 18-year-old Trevor D. Williams’ 2003 Dodge 1500 head-on. Williams’ vehicle rolled several times until it stopped off the highway. A total of seven people were injured in the multivehicle Missouri car accident. Trevor D. Williams and his passengers, 18-year-old Joshua A. Ogan, and 17-year-old Taylor N. Hood, were seriously injured in the accident. Jereth D. Schrock and one of his passengers, 20-year-old Emily K. Warren sustained moderate injuries. His other passenger, 18-year-old Jaque J. Willis sustained only minor injuries. The young adults injured in the multivehicle Missouri car accident were taken to local hospitals Truman Medical Center, Research Hospital, Overland Park Regional, and KU Medical Center by Belton EMS, South Metro EMS, Lifeflight Eagle, and a private vehicle. The accident report did not specify whether or not alcohol played a role in the accident. Holiday celebrations increase the risk of alcohol-related accident since many festivities include drinking. In 2008, statistics showed that alcohol-related accidents contributed to more than 3,500 car accidents. Dealing with an alcohol-related accident can be stressful for many Missouri car accident victims. Every person who is in an alcohol-related Missouri car accident should do the following: Meet with an experienced Missouri car accident attorney, take a defensive driving course, and seek counseling if needed. An experienced Missouri car accident attorney will help the injured party recover for medical bills, pain, and suffering. A defensive driving course will help the car accident victim to be as prepared as possible to avoid car accidents in the future. Sometimes counseling for Missouri car accident victims is necessary if the injuries are severe or a loved one was lost in the same accident. If you are injured in an alcohol-related car accident, contact our experienced Missouri car accident attorneys at 888.956.2487 and we can help you with the rest and fight for your rights as a victim. ******************************************************** Joshua P. A Missouri head-on car accident on April 18, 2011 left four Missourians including a small child in Lafayette County, Missouri injured. The vehicles involved in the head-on collision were driving in opposite directions along the center line of Rolling Hill a little further east of MO-213. A 2004 Hyundai driven by 23-year-old Melanie R. Dysart of Dover, Missouri was traveling eastbound in the center of the road. A 1989 Nissan driven by 19-year-old Tiffany R. Earnest of Higginsville, Missouri was traveling westbound, also in the center of the road. The two vehicles crashed on a hill. Most of the victims in the Missouri head-on collision were not wearing their safety belts. Tiffany Earnest suffered serious injuries and was taken to the Research Medical Center in Kansas City, Missouri by Higginsville E.M.S. Tiffany Earnest’s passenger, 22-year-old Gary J. Earnest was also seriously injured in the Missouri head-on collision and taken to Truman Medical Center by Lifelight Eagle air ambulance. Melanie Dysart was moderately injured in the Missouri car accident and was taken to Centerpoint Hospital by Higginsville E.M.S. Considering the severity of the Missouri head-on collision, one-year-old Tilian Sinkler only suffered minor injuries from the accident. Fortunately, the toddler was the only passenger in the accident to be secured properly by a safety belt. Missouri has child passenger laws to protect the safety of children in the event of an accident. Experienced Missouri car accident attorneys know the child passenger laws and can use these laws to help victims receive compensation. A side-impact Missouri car accident occurred when 27-year-old Amber M. Lewis of Bixby, Missouri drove through a stop sign on Business 67 in Cherokee Pass. Lewis drove in to the path of 18-year-old Whitney N. Kemp of Fredericktown, Missouri. The Missouri car accident caused both vehicles to run off the road and down into an embankment. According to the Missouri State Highway Patrol, both vehicles caught fire in the accident. Both drivers were injured in the Missouri car accident and so were the passengers of both vehicles. Lewis suffered minor injuries, but her passenger Bruce E. Copeland of Bixby, Missouri, was moderately injured. Lewis & Copeland were taken to Madison Medical Middle in Fredericktown, Missouri by ambulance for treatment. It is reported that neither Lewis or Copeland were wearing a seat belt in the Missouri car accident. Kemp’s passenger, Robert D. Berry of Fredericktown, suffered serious injuries in the Missouri car accident. Kemp and Berry were taken to the Parkland Hospital in Farmington, Missouri for treatment. Missouri statute §304.271 requires drivers to abide by traffic-control instructions, which include stop signs. The only exemptions to the statute are authorized emergency vehicles. A driver who fails to stop at a stop sign violates the Missouri statute will most likely be charged with a class C misdemeanor. Statute violations can be used to prove a driver’s negligence in a Missouri car accident. A victim of a victorious negligence claim in a Missouri car accident will show that: (1) the driver owed a responsibility to the victim, (2) the driver violated that responsibility, (3) the negligent behavior was the cause of the injury to the victim, and (4) the Missouri car accident victim has sustained a loss as a result of the negligence and injury. Missouri Traffic statutes were established to protect the rights of the passengers, pedestrians, and others, which drivers owe. If the victim can prove with evidence that the defendant was negligent, the defendant must pay the victim compensation for injuries sustained. There are many ways a negligent driver can be dangerous on the road. When a driver does not pay attention or makes a dangerous decision, victims have to deal with the stress of the accident. If you have been injured in a Missouri car accident, please consult an experienced car accident attorney immediately. One man was killed and another injured in a Missouri car accident when two F150s collided on Route H in Perry County Missouri on April 4, 2011. 39-year-old Michael Tomkins of Herrin, Illinois was driving on Route H when his wheel slipped off the roadway. Tomkins overcorrected his 1998 Ford F150, which caused him to slightly travel off the other side of the road. Cape Girardeau resident, 44-year-old James Buck tried to swerve his 2004 Ford F150 to miss Tomkins, but they collided. As a result, Buck’s truck overturned. The Assistant Coroner pronounced Tomkins dead at the scene of the accident at 8:45 am. Buck was taken to the Perry County Memorial Hospital by ambulance with moderate injuries. Both trucks were totaled and Tomkins was reportedly not wearing his safety belt. Missouri statute §307.178 requires that all drivers and passengers in the front seat wear a seat belt. Missouri safety advocates have repeatedly pushed to change the law. MoDOT and the state transportation director want lawmakers to change §307.178 to allow primary enforcement. Primary enforcement would allow law enforcement to pull over cars in which some is not wearing a seatbelt. Safety advocates additionally want the law to require all passengers to wear a safety belt, not just front seat passengers. While on the road, you should always be safe. Wearing a seatbelt isn’t an option anymore even though law enforcement officers won’t pull someone over just because they are not wearing a seat belt. Even when you drive carefully, there are other people on the road that you can’t control and Missouri motor vehicle accidents happen. If a negligent driver injures you, call 888.956.2487 to speak to an experienced Missouri motor vehicle accident attorney to discuss your claim and your rights as a victim. ************************************************** Joshua P. A car accident in Jefferson City leaves a 22-year-old injured on Missouri Boulevard. The accident occurred as 20-year-old Abby Luetkemeyer attempted a left hand turn from the K-Mark parking lot at the 2300 block of Missouri Blvd. Luetkemyer pulled her 2002 Chevrolet truck into the center lane jus as 22-year-old Serenity Crump walked across the boulevard. Luetkemyer struck Crump sending her to the hospital with moderate injuries. The public was not surprised by the pedestrian car accident in Jefferson City. One resident wrote in an online submission, “I see people trying to cross MO Blvd on foot all the time. It’s insane. The city needs to implement safe ways for pedestrians to get across or this kind of accident will become more prevalent.” Because Jefferson City is become more populated, the roads are becoming more congested. As a result, a higher number of traffic accidents are reported. According to the Missouri State Highway Patrol’s data, Jefferson City ranks 14th out of 734 Missouri cities in traffic accidents. Pedestrian accidents are likely to continue with the absence of regular crosswalks and congested roads. Missouri Boulevard and other roads without sidewalks on either side create a greater risk to pedestrians as more people are choosing to walk or bike to their intended locations. Pedestrians in Jefferson City, Missouri may be just as responsible for an accident as a driver. If the Missouri car accident is partially the fault of the pedestrian, the amount of compensation could be limited. The driver’s attorney could argue that the pedestrian, whether by jaywalking or ignoring a traffic signal, is at fault for the accident. In order to receive compensation for injuries sustained in a pedestrian car accident, an experienced attorney is recommended. If you are injured in a pedestrian accident, contact one of our experienced pedestrian accident attorneys at 888.956.2487. Our attorneys will aggressively investigate your accident in order to protect your compensation rights. ************************************************** Joshua P. Two residents from Marston, Missouri were killed over the holiday weekend. The fatal car accident happened at Morehouse on US-60 and MO-114. The Missouri car accident happened as Charlie S. Hammons pulled his 1998 Ford into the pat of Bryian G. Brown’s 1996 Chevrolet. Brown’s vehicle slammed in to Hammons’ vehicle, which pushed both vehicles off the road. Although all occupants in Hammond’s vehicle were wearing seatbelts, Hammond’s was ejected from the Ford. Hammons was taken to St. Francis Hospital for medical treatment by Air Evac, but the 93-year-old was pronounced dead by the Cape Girardeau Coroner. Essie P. Hammons, the 87-year-old occupant of Hammons, was pronounced dead at the scene of the Missouri car accident by Stoddard County Coroner. The only survivor in the Ford was a teenager. George D. Brown of New Madrid, Missouri suffered moderate injuries and was taken to Missouri Delta Medical Center by ambulance. In the event of a Missouri car accident that results in the death of the at-fault driver, many injured victims wonder how they will recover damages. The ability to sue an at-fault driver even after his or her death depends on whether or not the jurisdiction has passed a law called a survival statute. Survival statutes determine that a personal injury case will survive even if the at-fault party does not. Missouri’s survival statute is Missouri statute §537.020. This statute states that the cause of action for personal injuries “shall not abate” because the at-fault party has passed away. The personal injury cause of action survives to be a representative of the deceased party. Missouri statute §537.020 authorizes the probate court to appoint a representative for the at-fault driver. Bring a claim against a deceased at-fault driver is many times referred to as “suing the estate of the deceased.” The Missouri car accident victim will not receive a lesser settlement just because the defendant is deceased. Missouri law determines that “the liability and the measure of damages shall not be the same as if such death or deaths had not occurred.” If the Missouri car accident victim had received a judgment of $50,000 against a living defendant, the accident victim would receive a $50,000 settlement against the deceased. While on the road, drivers have a responsibility to other motorists to make responsible decisions. If you are injured or lose a loved one in a Missouri car accident where the at-fault driver passes away before you are able to make a settlement, call a Missouri car accident attorney immediately. An experienced Missouri car accident attorney will understand how to use Missouri’s survival statute to receive compensation for your injuries or your loss. A car accident in Johnson County, Missouri leaves a teen from Lee’s Summit seriously injured. A woman from Ohio was also injured in the multivehicle car accident, which occurred at 4:20 p.m. on MO-10 on June 13, 2011. Lee’s Summit resident, 17-year-old Jackson J. Hill, attempted to pass the 2003 Chevrolet driven by Angela D. Hardy of Warrensburg. In the process of passing in his 2002 Honda, Hill clipped the left rear corner of Hardy’s vehicle. After colliding with Hardy’s Chevrolet, Hill collided with a 1997 Honda driven by John M. Gallagher from Independence. As a result of the multivehicle accident, Hill was ejected from his vehicle. Hill sustained serious injuries and was transported to Research Hospital in Kansas City, Missouri by LifeFlight EMS. A passenger of Gallagher’s vehicle, Tammy S. Mahan from Ohio, was taken by Johnson County EMS to Centerpoint Hospital in Independence, Missouri for treatment. The Missouri Highway Patrol reported that an investigation into the accident has been launched and that charges are pending. As Johnson County, Missouri becomes more populated, car accidents are becoming more frequent. The population in the Missouri County is increasing because of resident overflow from Kansas City, Missouri. As the population continues to grow, traffic accidents also increase. In 2009 there were over 1,000 car accidents in Johnson County, Missouri. The residents of Johnson County should consider taking a defensive driving course to defend against negligent drivers. Missouri defensive driving courses help teach drivers techniques to avoid traffic collisions. These courses also teach drivers how to compensate for poor road conditions, prevent accidents, and deal with aggression while driving. There are many ways a negligent driver can be dangerous on the road. When a driver does not pay attention or makes a dangerous decision, victims have to deal with the stress of the accident. Defensive driving courses can help you prepare for dangerous situations, but occasionally an accident is unavoidable. A multiple vehicle car accident and three injured Missourians was the result of a car chase in Taney County. On June 4, 2011 around 8:10 p.m. on Route F close to Branson, Missouri Bernard H. Johnson was pursuing Benjamin K. Sanders. The accident occurred as Sanders drove his 1982 Honda Gold Wing on Route F as Johnson chased him in his 2004 Ford Crown Victoria. During the pursuit, Sanders crossed the centerline of the road and hit Jodi M. Ebersol’s 1997 Ford Taurus head on. The force of that head-on collision pushed Ebersol into another head-on collision with Johnson’s vehicle. All vehicles involved in the accident were totaled. 37-year old Ebersol received serious injuries in the accident. 31-year-old suffered moderate injuries and 69-year-old Johnson only suffered minor injuries in the Missouri car accident. It is unclear why Johnson was pursuing Sanders in the first place. Missouri car accidents that involve more than two vehicles are considered multivehicle accidents. Determining the at-fault driver in a multivehicle car accident can be difficult because multiple drivers can cause possible negligence. Disputes over the factual evidence as to which party was the direct cause of an accident becomes more complex the more drivers that are involved. Understanding what to do after a Missouri multivehicle accident is vital for making the best case to receive compensation for injuries sustained in the accident. If possible, your first course of action should be to call 911 and report the accident and any known injuries. Even if there are no serious injuries to be reported, having an accident report on record will benefit your personal injury case. If the accident is not recorded with the local police department, the responsible parties may change his or her story, which will prompt his or her insurance company to offer less in compensation. Your second course of action after alerting the local authorities is to take pictures of the accident. Photographs are excellent evidence for personal injury cases that involve Missouri car accidents. Pictures should be taken before the clean-up crew moves the vehicles from the road. Your third course of action would to be to get medical treatment for any injuries. Of course if you sustained serious injuries, this would be your fist course of action. When the ambulance reports to the accident, do not refuse medical treatment. Describe any pain, no matter how small or minor, to the paramedics. Your final course of action after a Missouri car accident is to follow up with your doctor. Many times car accident victims will not show symptoms of injuries until later. Most common injuries to show delayed symptoms are the very serious injuries to the brain or spinal cord. There are many ways a driver can be negligent, which is dangerous to motorist. In this case, pursuing another driver at high speeds puts other’s lives at risk. When a driver makes dangerous decisions, Missouri car accident victims have to deal with the stress of his or her injuries and property damage. If you have been injured in a Missouri car accident, please consult an experienced car accident attorney immediately. Seeking legal counsel soon after an accident is essential to build a case against a negligent driver. Call 888.956.2487 to discuss your motor vehicle accident claim and let us investigate for you. ************************************************************ Joshua P. A Missouri car accident in Newton County injures six people from Granby and Monett. The Missouri car accident occurred on US 60 just three miles east of Granby at 6:45 p.m. on June 6, 2011. Just before the accident, Pam L. Sternes of Granby, Missouri waited to make a left turn in her 2002 Ford Windstar. Matthew D. Tucker of Neosho, Missouri was unable to stop his 1997 Volkswagen Jetta and rear-ended Sternes’ van. The collision forced Sternes’ van into oncoming traffic resulting in a head-on collision with Sharrie L. Harman of Monett, Missouri. Harman’s 2006 Dodge Charger along with the other vehicles involved in the accident was totaled. Two drivers, Hartman and Sternes, were seriously injured in the Missouri car accident. Hartman was taken to Cox South Hospital in Springfield, Missouri and Sternes was taken to Freeman West Hospital in Joplin, Missouri. Four other injuries were reported from the minors that occupied Sternes’ Windstar: 10-year-old Nathan C. Sternes, 12-year-old Lauren Sternes, 13-year-old Kyle A. Sternes, and 14-year-old Cotton C. Jones. It is unknown the extent of the minors’ injuries. In Missouri car accidents, governed by state tort law, injured individuals should receive compensation. Missouri tort laws allow victims of car accidents to recover losses caused by the at-fault driver and their insurance company. In some cases, Missouri car accident victims cannot receive full compensation with a lawsuit because the at-fault driver does not have adequate insurance or files for bankruptcy. Before 1987, Missouri car accident victims would not have received full compensation for their losses. However in 1987, a Missouri legislation was passed that established the Missouri Tort Victims’ Compensation Fund to help compensate victims who are not able to receive compensation through a lawsuit. Missouri car accident victims who have obtained a judgment for a wrongful death or personal injury lawsuit, but are unable to collect the full amount of compensation are eligible to file a claim for the Missouri Tort Fund. Missouri accident victims who settle for the maximum amount of compensation from the at-fault driver’s liability insurance without being fully compensated for their losses are also eligible to file a claim for the Missouri Tort Fund. Some family members are also able to file a claim if the victim is deceased as a result of injuries from the Missouri car accident. The driver of a passenger vehicle has a duty to exercise reasonable care while driving. If a driver does not exercise care while driving, he or she can seriously injure other people on the road. An experienced Missouri car accident attorney can argue that the at-fault driver was negligent in his or her actions and did not act with reasonable diligence. If you are involved in a Missouri car accident with a negligent driver, call 888.956.2487 and speak to one of our experienced Missouri car accident attorneys. Our knowledge will build a case of neglect against the distracted driver. ******************************************************* Joshua P.
