Six people were taken to Lincoln County area hospitals after a Missouri car accident that occurred on August 27, 2011. Injured in the car accident were two adults, three teenagers, and one child with injuries ranging from minor to serious. The accident happened on Highway 47 at Gravens when 19-year-old Angela S. Linhorst ran a stop sign in her 1999 Ford Taurus. In the middle of the intersection, Linhorst collided with the front end of James E. Koeneman’s 2003 Ford F150. Linhorst’s vehicle was totaled and Koeneman’s vehicle only received moderate damage. Linhorst and three of her occupants, 15-year-old Heather Schneider, 13-year-old Nichole Lindhorst, and 10-year-old Alex Schneider, suffered minor injuries. Koeneman’s occupant, 30-year-old Douglas J. Koeneman suffered moderate injuries. One occupant in Linhorst’s vehicle, 13-year-old Abigail Schneider was seriously injured and airlifted by Air Evac to Children’s Hospital to be treated. All other injured victims were taken by Lincoln County Ambulance to St. Joseph West Hospital. Running a stop sign or a red light is a violation of Missouri statutes 304.271, which requires all drivers to obey all traffic control devices. The statute states, “The driver of any vehicle shall obey the instructions of any official traffic-control device applicable thereto placed in accordance with the provisions of the law.” When a driver violates the statute they put others in danger. When a driver runs a red light or stop sign and it results in a Missouri car accident, the violation of the statute could be used to prove the negligence of the driver in a personal injury case. There are many ways a negligent driver can be dangerous on the road. When a driver does not pay attention or makes a dangerous decision, victims have to deal with the stress of the accident. If a negligent driver has injured you, please consult an experienced Missouri car accident attorney immediately. Seeking legal counsel soon after an accident is essential to building a case against the negligent driver. A Chesterfield, Missouri car accident ended with a popular Whitfield teacher and her son suffering serious injuries. The accident happened Friday night as Janet Esrock and her son Jonathan Esrock left a high school football game. A Chevy Tahoe that was speeding down Wildhorse Creek Road hit Janet Esrock, a teacher and coach at the high school, and her son, a sophomore at the high school. Although the Missouri State Highway Patrol did not release a crash report for the Missouri car accident, but local reports state the Chevy Tahoe was driven by a 53-year-old and the accident could have been caused by alcohol. The Missouri head-on collision required the Esrocks to be extracted from the vehicle by the Monarch Fire Protection District paramedics. The Missouri car accident victims were rushed to St. John’s Mercy hospital. Janet Esrock was reported to require a respirator to breathe and her son had to have surgery for a number of broken bones. A Whitfield High School official sent a pubic email letting the community know that the Missouri car accident victims were sedated and could not see visitors from the broader community at this time. Missouri car accidents are stressful enough, but they become more distressing when a member of the community is injured. The car accident victim must deal with the injuries suffered from the accident and the family must deal with the financial burdens of lost wages and medical bills. Members of the community such as friends, students, and colleagues have to deal with the emotions surrounding the uncertainty of the accident victim’s recovery. When an intoxicated driver is on the road, he or she endangers everyone. Although Missouri car accident attorneys cannot heal the accident victim or the community, they can help the victim recover the financial loss that was a result of the accident. Missouri car accident victims can recover money associated with lost wages, medical bills, and pain and suffering. If you have been injured in a car accident, please consult an experienced Missouri car accident attorney immediately. Seeking legal counsel soon after an accident is essential to building a case against the intoxicated driver. Call 888.956.2487 to discuss your car accident claim and let us investigate on your behalf. ********************************************************* Joshua P. A Butler County, Missouri car accident on MO-142 claimed the life of 18-year-old Alexander C. Metzig, but the driver was no where to be found. On August 14, 2011 just before 10 p.m., Metzig slowed his scooter to make a right turn off of the road. As he slowed his scooter, he was rear-ended by a dark blue truck and the truck took off. Alexander Metzig was pronounced dead by Joe Chapman, the Butler County Deputy Coroner. As a Missouri car accident attorney I was upset to find out that the Missouri State Highway Patrol does not the identity of the driver of the dark blue truck responsible for the hit and run. A hit and run accident is a crime no matter what state the accident happens. As in all states, Missouri has a hit and run statute. Missouri statute §577.060 prohibits a driver from leaving the scene of a Missouri car accident when “knowing that an injury has been caused to a person or damage has been caused to property, due to his culpability or to accident, he leaves the place of the injury, damage or accident without stopping and giving his [information].” In Missouri a driver has violated the hit and run law if he or she leaves the scene of a Missouri car accident. Those who leave the scene of the accident can be punished criminally. In a typical hit and run accident, it is a misdemeanor crime. However it will only be charged as a misdemeanor if the Missouri car accident only causes small property damage. As an example, if a driver hits a mailbox at a low speed and leaves the scene, he or she will be a misdemeanor violation of Missouri statute §577.060. If a driver leaves the scene of an accident, it could be considered a class D felony under certain circumstances. A driver can be charged with a felony in three circumstances. If driver has previously violated the Missouri statute, causes more than $1000 in property damage, or causes injury to another party. When a hit and run driver causes a fatality, he or she could be punished severely. If you have lost a loved one to a hit and run, call 888.956.2487 to speak to an experienced Missouri car accident attorney and let us help you. Our attorneys protect the rights of hit and run accident victims because the family needs closure. *************************************************** Joshua P. The Missouri car accident occurred on July 29, 2011 as 51-year-old Diana L. Czeschin crossed the centerline near Red Bird Road on Route B. When Czeschin attempted to correct her 1995 GMC truck, she overcorrected and traveled off the right side of the road. The Bland, Missouri resident crashed into a tree and was pronounced dead by, Ben Grossman, the Gasconade County Coroner. Czeschin was not wearing her seatbelt during the Missouri car accident. Single vehicle Missouri car accidents are far too common. According to the National Highway Traffic Safety Administration (NHTSA), there were over 20,000 single vehicle car accidents in 2008. Of the 20,000 single vehicle car accidents, 10,000 happened off the road. Determining who is liable in a single vehicle Missouri car accident can be difficult considering the circum stances. Most single vehicle car accidents are usually the fault of the driver; however, in some cases another party may be responsible. As an example, a unit of the government could be responsible. Local and state governments are tasked with setting speed limits that are appropriate for the road. These speed limits will vary depending on the terrain. The State of Missouri has set an over all maximum speed limit for the state in statute §304.010. According to this statute, rural highways have a maximum speed limit of 70 mph whereas rural expressway speeds are set at 65 mph. The maximum speed for urban interstates and lettered two-lane highways is 60 mph. The Missouri statute §304.010 decides the maximum speed limit for the whole state, but local government units may lower the limits if necessary. The local or state government may be held liable for a single vehicle Missouri car accident if the posted speed limit is too high to accommodate the road condition or terrain. If the Missouri car accident victim was driving under the maximum posted speed limit at the time of the accident, the victim’s family could argue that the government was not diligent in posting an appropriate speed for that particular road. If you are injured in a single vehicle Missouri car accident as a result of a negligent driver or improper speed limit posting, contact one of our experienced Missouri car accident lawyers immediately. Call 888.956.2487 and speak to one of our experienced Missouri car accident attorneys. The accident happened as Addie K. Kronk of Fulton, Missouri was driving down Route WW near County Road 350 in her 2005 Chrysler. A 2010 Mercedes, driven by Matiul Islam, was driving too fast around a curve in the opposite direction and caused the head-on Missouri car accident. Kronk was transported to University Hospital by ambulance to be treated for serious injuries. Islam and his wife, Fetema Islam were also seriously injured in the head-on collision and taken to University Hospital. The Missouri State Highway Patrol did not state in their report if Islam was driving over the speed limit at the time of the accident. Driving over the posted speed limit is a violation of Missouri law, especially if it causes a Missouri car accident. If the at-fault driver was going faster than the maximum speed limit when he caused the Missouri car accident, then Kronk’s Missouri injury lawyer will have a stronger personal injury case. A strong personal injury case will almost ensure that Kronk will receive compensation for her injuries. The posted speed limits are used to decrease the number of Missouri car accidents and improve safety for all drivers. Driving faster than the posted speed limit puts everyone on the road in danger and violates traffic laws. When speeding causes a Missouri car accident, the victim has a good case to file a personal injury lawsuit. Missouri car accident victims can sue the at-fault driver for the injuries suffered in the accident. By proving the at-fault driver was speeding is to prove that he or she was negligent in the Missouri car accident. Driving over the posted speed limit violates safety regulations so it is considered negligent. If you have been injured in a Missouri car accident, please consult an experienced car accident attorney immediately. Seeking legal counsel soon after an accident is essential to building a case against the negligent driver. Call 888.956.2487 to discuss your car accident claim and let us investigate on your behalf. *********************************************** Joshua P. A single vehicle accident claimed the life of a woman in Missouri. The car accident happened at dawn near Russell Blvd on I-55. The Missouri car accident victim crashed her SUV into a bluff and was ejected from her vehicle. She was pronounced dead at the scene. The Missouri car accident shut down the southbound lanes of I-55 for nearly three hours, bringing morning traffic to a stop. The accident is under investigation and details of the woman in her 30s were not released. Most Missouri car accidents that only involve one vehicle are the fault of the driver. Driving over the speed limit or alcohol consumption could cause the car accident. A distracted driver may also drive off the road because he or she is not paying attention. There are many single Missouri car accidents that are caused by the negligence of others. Single vehicle car accidents can be caused by debris from another vehicle, animals, fallen trees, and other unexpected obstacles. Drivers will swerve to try to avoid the obstacles, which increase their risk of a Missouri car accident. If another driver or party causes an obstacle, than the other driver will be liable for the injuries even if it is a single vehicle accident. I’ll use a truck’s improperly secured load as an example. If the load falls from the truck and causes another driver to crash, then the commercial trucking company could be held responsible. Trucking companies have a responsibility to make sure the load is secure as to prevent car accidents. A single Missouri car accident can also be the result of a defective part of vehicle or improper repairs. The example here is a defective tire. If the driver is unaware he or she is driving on a defective tire and has a blowout that causes an accident, the tire manufacturer could be liable for the driver’s injuries. Poor design of a vehicle will increase the likelihood of a rollover during a Missouri car accident, which causes the driver’s injuries to be worse. In cases such as this, the vehicle manufacture could be held liable. Sometimes a car accident is unpreventable and will lead to injury. If you are injured in a Missouri car accident as a result of a negligent driver or manufacturer, contact one of our experienced Missouri car accident lawyers immediately. Call 888.956.2487 and speak to one of our experienced Missouri car accident attorneys. Our knowledge will build a case of against the person who is at fault for causing the single vehicle accident. ****************************************************** Joshua P. An O’Fallon, Missouri man was hospitalized after a car accident in St. Charles County, Missouri. The Missouri car accident happened on I-64 on July 19,2011. Wright City resident, Erin N. Dorlaque, drove her 2005 Cadillac into the rear of Michael W. Huffman’s 2002 Ford Expedition while traveling eastbound on I-64. The force of the collision caused both vehicles to drive off the road and rollover. As a result of the Missouri car accident, Huffman was ejected from his vehicle. Huffman was taken to St. John’s Medical Center by St. Charles County Ambulance to be treated for serious injuries. It is not uncommon that the lighter SUV rolled over in the Missouri car accident. Light SUVs, trucks, and vans account for the largest number of rollover accident. SUVs, trucks, and vans have a higher center of gravity than the smaller passenger cars. Automobiles with a higher center of gravity have a higher rollover rate during a collision because of this factor. Sadly, the fatality rate for vehicles such as these in a rollover accident is upward to 59%. SUVs are not equipped to handle rollover accidents, especially since side airbags are not standard in most of the vehicles. The roof of an SUV or vehicle with a higher center of gravity is not designed to maintain the weight of the vehicle and occupants when the vehicle rolls over. The pressure that is put on the roof causes it to collapse under the weight, which can lead to serious injury or death. In Missouri rollover car accidents, occupants may be ejected from the vehicle. Bodily injury or death can occur from a car accident ejection. National Highway Traffic Safety Administration concludes that 74% of vehicle occupants were ejected and died over the span of a year. Wearing a seat belt is the best way to prevent an ejection in the event of a Missouri car accident. Of the people who wore a seat belt, only 1% was completely ejected from the vehicle in a car accident. Car accident victims who are in a rollover accident usually require a lot of medical treatment. The victims may miss a lot of work to recover from the injuries sustained in a Missouri car accident. As a result, they lose important wages. In Missouri, injured victims can fight for compensation. An experienced Missouri car accident lawyer will help fight to make sure victims receive the most compensation. If you are involved in a Missouri car accident with a distracted driver, call 888.956.2487 and speak to one of our experienced Missouri car accident attorneys. **************************************** Joshua P. A rear-end accident in Callaway County, Missouri on route J injured Shyan M. Clark from Fulton, Missouri. On May 17, 2011, 33-year-old James R. Allen was stopped in his 2003 Saturn behind another vehicle, which was also making a left turn. 55-year-old Deborah J. Roberts failed to stop her 2005 Lincoln resulting in a rear-end collision. Another vehicle, driven by 40-year-old Shelly Basnett struck Roberts vehicle resulting in a second strike to Allen’s vehicle. Another driver, Renee M. Knipfel, then collided with Basnett’s vehicle. The only reported injury was that of 12-year-old Shyan M. Clark who suffered moderate injuries and was taken to Callaway County Hospital by ambulance. She was not wearing a seat belt during the collision. Missouri law requires all children 15-years-old to wear a seat belt while in a moving vehicle. Children in Missouri are required to wear a seat belt regardless of where in the vehicle they are located. The Missouri child restraint laws are different than the seat belt laws for adults, which only require an adult wear a seat belt in the front seat. Law enforcement officers can pull over any vehicle where a child is not properly restrained with a safety belt. There are a few exemptions to the restraint law, which are parades and agricultural reasons. Missouri’s child safety belt law decreases the risk of injury and death for children involved in a motor vehicle accident. According to the Center for Disease Control and Prevention, nearly 184,000 children are injured in Missouri car accidents every year. Several studies indicate that seat belts greatly reduce the number of car accident injuries of children. The CDC recommends that all children under the age of 12 only sit in the back seat to avoid risk from air bags or dash impact. While on the road, you should always be safe. Wearing a seatbelt isn’t an option anymore even though law enforcement officers won’t pull someone over just because they are not wearing a seat belt. Even when you drive carefully, there are other people on the road that you can’t control and Missouri car accidents happen. If a negligent driver injures you, call 888.956.2487 to speak to an experienced Missouri motor vehicle accident attorney to discuss your claim and your rights as a victim. *************************************************** Joshua P. A rear-end car accident in Jefferson County, Missouri killed a teenager and injured seven people on May 1, 2011. The accident happened as a Chevrolet Impala driven by Michael A. Rayfield from Fetus, Missouri and a Ford Escort driven by Holly J. Duncan were stopped at a red light in the southbound lanes of US-67 at the cross intersection of Meyer Road. A Pontiac G8, driven by Daniel B. Torrence, failed to stop crashing into the rear of Duncan’s vehicle. The force of the collision caused Duncan’s Ford to rear-end Rayfield’s vehicle. Unfortunately, 15-year-old Thomas A. Duncan from Bonne Terre, Missouri died after being transported to St. John’s Mercy Medical Center in Creve Coeur and than being airlifted to the Children’s Hospital. Seven other Missouri residents were also injured in the rear-end collision. Joshua Duncan, 9-years-old, was seriously injured along with 14-year-old Caleb Reed. The minors were transported to Cardinal Glennon Hospital by the Arch Helicopter transport. 39-year-old Holly Duncan, 11-year-old Paul Duncan, 37-year-old Daniel Torrence, and 14-year-old Blaise Torrence sustained minor injuries and taken to Jefferson Regional Medical Center by Joachim Plattin Ambulance. Filing a lawsuit to receive compensation for the death of a loved one, especially a child can take an emotional toll on people. Parents and family members are usually caught off guard when it is time to file a wrongful death claim because they cannot understand why their loved one suffered at the hand of another person’s negligence. Parents should rest assured, with an experienced attorney, that their children have the right to receive compensation for their injuries. If you have lost a loved one or a child, call 888.956.2487 to speak to an experienced Missouri wrongful death attorney to make sure your child’s rights are well-protected and the negligence of the other party are held responsible for their actions. *************************************************** Joshua P. A car accident in Miller County, Missouri killed four people and injured two others on May 8, 2011. Murali Bottu, a 22-year-old resident of Rolla, Missouri, lost control of his Toyota Camry in the westbound lanes of MO-42. As a result of losing control, Bottu crossed the centerline and overcorrected his vehicle causing the vehicle to flip sideways. Darren J. Denter, the driver of a Chevrolet Silverado, struck Bottu’s flipped vehicle on the passenger side. The force of the impact pushed both vehicles off the road, totaling them. All the occupants of Bottu’s vehicle were residents of Rolla, Missouri, were killed in the car accident. 22-year-old Sri H. Chittury, 23-year-old Dheeraj Gudlawar, 21-year-old Srikanth Ravi, and 24-year-old Srupun Velumula, all originally from India were pronounced dead at the scene by the Miller County Coroner at 12:10 p.m. The driver of the Camry, Bottu, was seriously injured in the accident and was air lifted to the University of Missouri Hospital in Columbia for treatment. The driver of the Silverado, Denter, refused medical attention at the scene, but his passenger Robert E Davis was taken by ambulance to the Lake Regional Hospital in Osage Beach. When a death is caused by misconduct, negligence, or carelessness, it is considered a wrongful death. In Missouri, wrongful death statutes all family members to recover damages. If the accident victim was a passenger in the vehicle, his or her family can also sue the driver. If a foreign citizen is a victim in a Missouri car accident, family members can still receive compensation under the Missouri wrongful death statutes. If a loved one has passed away in a Missouri car accident at the negligence of another, an experienced attorney will understand how to properly file a wrongful death claim in Missouri. Call 888.956.2487 to speak to an experienced Missouri car accident attorney to ensure the rights of the victim and the family will be well represented. ******************************************************* Joshua P.
